Litigation and Dispute Resolution

Litigation and Arbitration Lawyers in Egypt

When a commercial relationship breaks down in Egypt, the choice of forum, the way evidence is prepared and the timing of the first steps can decide the outcome. Foreign companies also face practical questions that domestic parties do not, such as which court has jurisdiction, whether an arbitration clause holds, and how a foreign award or judgment can be enforced here.

Al Majidi Law Firm represents multinational and foreign companies in commercial litigation, arbitration and settlement negotiations in Egypt. Our litigation team is led by a partner who heads the firm’s dispute practice, and works closely with our corporate and employment lawyers, so that disputes are handled with a full understanding of the underlying business.

Our Litigation and Dispute Resolution Services in Egypt

Commercial Litigation

We represent clients before Egyptian courts in disputes involving:

  • Breach of contract and commercial claims.
  • Shareholder disputes and corporate conflicts.
  • Business and partnership disagreements.

We prepare pleadings and evidence, develop the case strategy with your legal team, and manage the proceedings in line with Egyptian procedural rules.

Arbitration and Alternative Dispute Resolution

Arbitration is often the preferred forum for foreign companies in Egypt, and Egypt has a dedicated arbitration law (Law No. 27 of 1994). Egypt is also home to the Cairo Regional Centre for International Commercial Arbitration (CRCICA). We advise and represent clients in:

  • Domestic and international arbitration, including CRCICA and other institutional or ad hoc proceedings.
  • Drafting and reviewing arbitration clauses, so that they are enforceable when a dispute arises. See our Commercial Contracts practice.
  • Mediation, negotiation and settlement, when a commercial resolution serves you better than a ruling.
  • Challenging or defending arbitral awards.

Enforcement of Arbitral Awards and Foreign Judgments

Winning a case abroad is only half the task if the assets are in Egypt. We assist with:

  • Recognition and enforcement of foreign arbitral awards in Egypt, in line with the New York Convention, to which Egypt has been a party since 1959.
  • Enforcement of arbitral awards made in Egypt.
  • Recognition of foreign court judgments, which is subject to conditions under Egyptian law.

Real Estate, Construction and Infrastructure Disputes

We handle disputes arising from property transactions, leases, construction contracts, project delays and contractor claims, and negotiate settlements where appropriate. For project-related work, see our Energy and Infrastructure practice.

Banking and Financial Disputes

We represent financial institutions and corporate clients in disputes over loans, securities and financial transactions, including matters involving regulators, insolvency and debt recovery. For related regulatory work, see our Capital Market practice.

Employment Disputes

We represent employers in labour claims, including termination disputes and workplace conflicts, before the competent authorities and courts. Learn more about our Employment practice.

Intellectual Property Disputes

For infringement claims, counterfeiting and brand disputes, see our Intellectual Property practice.

Frequently Asked Questions

Should we choose arbitration or Egyptian courts for disputes in Egypt?
It depends on the contract, the parties and where you may need to enforce. Many foreign companies prefer arbitration for its neutrality and confidentiality. Court proceedings may be more suitable in other cases. We advise on this at the drafting stage and again when a dispute arises.

Can a foreign arbitral award be enforced in Egypt?
Generally, yes. Egypt is a party to the New York Convention, and foreign awards can be recognised and enforced, subject to limited grounds for refusal. Enforcement in Egypt is normally applied for before the Cairo Court of Appeal.

Can a foreign court judgment be enforced in Egypt?
It can be, but recognition of foreign court judgments is subject to conditions under Egyptian law. This is more difficult than enforcing an arbitral award, which is one reason many international contracts choose arbitration.

What is CRCICA?
The Cairo Regional Centre for International Commercial Arbitration is an arbitral institution based in Cairo, widely used for international commercial disputes connected with Egypt and the region.

Can an arbitral award be challenged in Egypt?
Egyptian arbitration law allows awards to be challenged only on limited grounds and within a fixed time. This is an area where early advice matters, whether you are seeking to annul an award or defending one.

What should we do first when a dispute arises?
Preserve your documents, avoid statements that could be used against you, and check the contract’s dispute resolution and notice provisions before taking any step. Contact us early so we can advise on the strongest position.
